Is it illegal to make a NON-COMMERCIAL game based on a TV series? Or can you still get in trouble. Was permission needed from Paramount to make Quadrant Wars?
I want to make a arcade shooter based on one of the Gundam Series. |

1) Viacom is the owner of Star Trek, I believe. I've done enough inquiries abotu this in the past, no response ever.
2) QW was a clone of Netrek.org. But, if needed I'd replace Enterprise with Enterprize, Romulan to Romolan, and Klingon to Klongin :P |

well since it is BASED and NON-COMMERCIAL i think u arn't violating the copyright laws... anyway, better search more about it, btw what tv series are? |

As far as I know, in America, copyrights last for 99 years. This might be only for text and not TV shows though. |

Copyright is assigned automatically to all published works in most countries and lasts 50 years unless in the case of multiple authors, then it lasts the life of the last surviving author + 50 years.
You can probably use the name of the show in the game name as names generally arent considered as copyrighted works. Using graphics and sounds from the show however is a no-no unless you either have their concent or can prove that you use them for the purpose of critical literacy or teaching.
This constitutes "fair use" as provided for in section 107 of the US Copyright Law: "Sec. 107. Limitations on exclusive rights: Fair use "Notwithstanding the provisions of sections 106 and 106A, the fair use of a copyrighted work, including such use by reproduction in copies by any other means specified by that section, for purposes such as criticism, comment, news reporting, teaching.
If you recreate all the images and sounds based from the series to use in your game then you should be fine. That means tracing etc.
P.S. dont use their logo :) |
